Terms of Service

These Terms govern use of cassen.ca and the CASSEN Testing Laboratories customer portal (collectively, the "Services"). By using the Services you agree to these Terms. If you disagree, do not use the Services.

Services

We provide analytical chemistry testing and related consulting. All work is performed under our ISO/IEC 17025 quality system to the extent the specific test falls within our accredited scope. Reports and results apply only to the specific samples analyzed and the methods documented in each report.

Accounts

You are responsible for the accuracy of information you submit and for maintaining the security of your account. Do not share credentials. Notify us promptly of any unauthorized access.

Submissions, pricing, and turnaround

• Prices and turnaround are governed by the quote accepted for your project, or our current published schedule if no quote is in effect. Rush surcharges apply per the published schedule unless superseded by your quote.
• Turnaround begins the business day the laboratory receives the samples and a completed chain-of-custody form.
• You are responsible for sample integrity up to delivery at the laboratory and for providing accurate site, matrix, and hazard information.
• We may reject, hold, or request clarification on any submission that is unsafe, out of scope, or improperly documented.

Reports and data

Reports are provided in PDF format and sometimes as structured data. Reports are the customer's property to use for their internal purposes; CASSEN retains copies for quality-system and accreditation compliance. Reports must not be altered, excerpted, or republished without written permission.

Payment

Unless a credit account has been approved, invoices are due within the payment terms stated on the invoice. Overdue balances may incur interest at the rate permitted by law. Credit-application details and trade references submitted through the portal are reviewed and may be verified.

Confidentiality

Submission details, analytical data, and reports are treated as confidential. We only disclose them to you (or others you authorize), staff with a need to know, our service providers under contract, or as required by law or accreditation bodies.

Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising from the Services is limited to the fees paid for the specific analysis giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be excluded by law.

Intellectual property

The Services, including the site, portal, brand, and all content, are owned by CASSEN or its licensors. You receive a limited, revocable licence to use them for their intended purpose.

Termination

Either party may terminate use of the Services at any time. We may suspend or terminate access for breach of these Terms or to protect the Services. Sections that by their nature survive termination (confidentiality, liability, IP) continue to apply.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario have exclusive jurisdiction over disputes arising from the Services.
